As we’ve previously blogged about, legal marketing practices across the province have been increasingly scrutinized in recent months, after a Toronto Star investigation into the advertising habits of personal injury lawyers across the GTA revealed some allegedly questionable marketing campaigns.
Law Society Continuing to Scrutinize Legal Marketing Practices
Groups such as the Ontario Trial Lawyers Association (OTLA) have spoken out and stated that they want to “see the rules strengthened to eliminate false and misleading advertising that takes advantage of consumers”.
Meanwhile, the Law Society of Upper Canada (LSUC) is continuing its investigation into legal marketing and advertising across the province, with investigators currently considering 90 complaints involving advertising and referral fee issues.
The LSUC’s Advertising and Fee Arrangements Working Group is expected to report back with their final recommendations later this month, following the release of their initial interim report last June. We will continue to follow developments in this area and will provide updates as they become available.
Lawyers seeking to market their services should not be dissuaded from doing so, particularly since having an active presence on social media (including through a regularly maintained blog as well as use of Twitter, Facebook, Google+, LinkedIn, and other platforms) is becoming increasingly important, and therefore highly advisable. However, lawyers should be careful to maintain an online presence and market their services within the ethical parameters established by the LSUC, and must ensure that their advertising and marketing practices, both traditional and via social media, comply with the standards of the legal profession.
